Terms of Service

1. Acceptance of Terms

By accessing or using nameCrawl ("the Service"), including our website at namecrawl.dev, our API, and our CLI tool, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

nameCrawl is a domain availability checking platform that provides:

• Domain availability lookups across multiple TLDs via RDAP and DNS
• Registrar pricing comparison from third-party registrars
• Domain expiry monitoring and webhook notifications (Pro plan and above)
• Trending domain analytics
• A public API and authenticated API for programmatic access
• A CLI tool for terminal-based domain lookups

3. Accounts and Registration

To access authenticated features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and API keys. You agree to:

• Provide accurate and complete registration information
• Keep your API keys secure and not share them publicly
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

4. Subscription Plans and Billing

nameCrawl offers free and paid subscription tiers (Starter, Pro). By subscribing to a paid plan:

• You authorize us to charge your payment method on a recurring monthly basis via Stripe
• Subscriptions automatically renew unless cancelled before the end of the billing period
• Upgrades take effect immediately; downgrades take effect at the next billing cycle
• All sales are final. We do not offer refunds for partial billing periods
• We reserve the right to change pricing with 30 days notice to active subscribers

5. API Usage and Rate Limits

Each plan includes specific rate limits and monthly query quotas. Exceeding these limits will result in temporary throttling or API errors. You agree not to:

• Circumvent or attempt to bypass rate limits
• Use multiple free accounts to exceed quota limits
• Resell API access without prior written authorization
• Use the Service for any automated mass domain registration or squatting
• Interfere with or disrupt the Service or its infrastructure

Each TLD checked counts as one query. Using the skip-cache option (Pro and above) doubles the query cost.

6. Affiliate Links and Registrar Pricing

nameCrawl displays domain registration pricing from third-party registrars including Porkbun, Namecheap, GoDaddy, NameSilo, and Dynadot. Registration links may contain affiliate identifiers. We earn a commission when you register a domain through these links at no additional cost to you.

Pricing data is sourced from registrar APIs and may not reflect real-time prices. We do not guarantee pricing accuracy. Always verify the final price on the registrar's website before purchase.

7. Domain Data and RDAP

Domain availability results are obtained from public RDAP (Registration Data Access Protocol) registries, DNS lookups, and registrar APIs. This data includes domain status, registrar information, expiry dates, and nameservers. This is publicly available registration data, not private information.

We cache RDAP results to improve performance. Cached data may be stale. Use the skip-cache option (Pro and above) for fresh lookups.

8. Webhooks

Pro plan subscribers can configure webhook URLs to receive domain expiry notifications. You are responsible for the security and availability of your webhook endpoints. We validate webhook URLs to prevent abuse but are not responsible for data delivered to your endpoints.

9. Prohibited Uses

You may not use the Service to:

• Violate any applicable laws or regulations
• Engage in domain front-running, cybersquatting, or trademark infringement
• Harvest or collect data for spam or unsolicited communications
• Attempt to access other users' accounts or data
• Reverse-engineer, decompile, or disassemble any part of the Service
• Transmit malware or conduct denial-of-service attacks

10. Intellectual Property

The Service, including its design, code, and branding, is owned by nameCrawl. You retain ownership of any data you submit. By using the Service, you grant us a limited license to process your data as necessary to provide the Service.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that domain availability data will be accurate or complete. Domain availability can change at any time and results should be verified with the relevant registrar.

12. Limitation of Liability

To the fullest extent permitted by law, nameCrawl shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or domain registration opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Account Termination

We may suspend or terminate your account at any time for violation of these terms. You may delete your account at any time. Upon termination, your data will be deleted in accordance with our Privacy Policy. Active subscriptions will not be refunded upon termination for terms violations.

14. Changes to Terms

We may update these terms at any time. Material changes will be communicated via email or a notice on the Service. Continued use after changes constitutes acceptance of the updated terms.
